IMPORTANT: All "items" must reflect an action of "received" or "sent" before your case is considered ready for deliberation.

When inquiring about the status of a waiver case, the exchange visitor or representative should only contact the Department of State if the contents of the application appear incorrect or if the pending case file has accrued more than normal processing time.   Only a case file that contains all the necessary documents and inputs, will begin accruing processing time. All inquiries should clearly state the case number and the waiver basis.   Additional information about processing times, waiver basis definitions, or other waiver related information can be found at the J Visa Waiver portal . Also, due to recent changes in our case file management system, status information for those older cases with numbers below 800000 may reflect some irregularities.


How to read your status

Payment of fees opens your case file by assigning a case number and allows for submission of Form DS 3035.  This office then sends an instruction sheet to the address provided on Form DS 3035.  The waiver request, described below, must be sent directly by the sponsoring agency to this office.

  • No Objection case: A No Objection Statement must be sent directly to this office by the appropriate embassy in Washington, D.C., or its equivalent.
  • Hardship/Persecution case: Forms I-612/613 must be sent directly to this office by a USCIS service center.
  • Conrad/State 30 case: A request letter and all the required documents must be sent directly to this office by a state's Department of Public Health, or its equivalent.
  • Interested Government Agency (IGA) case: A request letter must be sent directly to this office by a head of a U.S. Federal Government Agency, or its designee.

Each tab reflects the type of waiver you requested on Form DS 3035 or your request for an advisory opinion on applicability of INA 212(e) two-year foreign residence requirement.  Presently, the IGA waiver designation, on Form DS 3035, does not distinguish between a physician and a non-physician IGA request.  If an incorrect type of IGA is reflected, please let this office know using the address listed below for CA/VO/DO/W.

Decision

A status of "Pending" or the actual decision will be displayed.

Your case will not be considered ready for deliberation until all the required documents and inputs are received, including the request letter from a sponsoring government agency described above.  DoS processing time will begin accruing upon receipt of all documentation required by regulation for the 212(e) waiver. Please note that processing time does NOT begin accruing with the payment of the fee or submission of the Form DS 3035.

Item

Items are documents or forms associated with a waiver basis, and include the required forms and request letters described above.  Items in bold-italic are documents or forms requested by DoS and are waiting to be received.  Some cases require more than the minimum number of documents, thus, take longer to process.

Action

Actions indicate whether an item has been requested, sent, or received by this office.

  • Requested - Documentation and/or views requested by this office.
  • Sent - Documentation sent by this office.
  • Received - Documentation received from the exchange visitor, agency or appropriated party.

Date

The date the action occurred for each item.
